1. Overview

These Terms of Service (“Terms”) govern your use of ondeckdelivery.com and any related online services that link to these Terms (the “Services”).

The Services are operated by On Deck Delivery, a cannabis delivery business based in La Habra, California (“On Deck Delivery,” “On Deck,” “we,” or “us”).

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

You should also read our Privacy Policy, which explains how we collect, use, and share information about you.

Cannabis is legal under California law but still illegal under federal law. You are responsible for using the Services only where and how it is legal for you to do so.

2. Who can use the Services

You may use the Services and place orders only if all of the following are true:

• You are at least 21 years old for adult-use (recreational) purchases, or at least 18 with valid medical cannabis documentation if and where medical purchases are allowed.
• You are in a location where cannabis delivery is legal and within our active delivery area in California.
• You can enter into a binding contract.

We will verify your age and identity where required. You agree we may ask for and check a valid government-issued ID, and where applicable, medical documents, at account creation, at checkout, and at delivery.

3. Website age gate and access

We may use an age gate or similar tool on the website to restrict access to people who confirm that they are old enough under California law. Age gating on cannabis websites is an industry expectation in California.

You agree not to bypass or fake the age gate or help someone else do it.

4. Accounts and security

To place orders or use some features, you may need to create an account.

You agree to:

• Provide accurate and complete information.
• Keep your login details private.
• Tell us right away if you think someone else is using your account.

You are responsible for what happens under your account, unless our own actions caused the problem.

We may suspend or close your account if we suspect fraud, abuse, or violation of these Terms or any law.

5. Product information and risks

We list cannabis and related products, including flower, vapes, edibles, concentrates, and other items.

• Product details like THC/CBD content, ingredients, strain type, and effects may come from brands, labs, and other third parties.
• We try to keep product information accurate, but we do not guarantee that all descriptions, potency values, or lab data are always complete, current, or error-free.

Cannabis affects everyone differently. Any information about effects, onset time, or benefits is for general information only. It is not medical advice. You should speak with a qualified health professional before using cannabis, especially if you are pregnant, nursing, have a medical condition, or take medications.

You are responsible for how you use products you buy from us.

6. Ordering and acceptance

When you place an order through the Services:

• You are making an offer to buy the items in your cart under these Terms.
• We may accept, modify, or reject your order at our discretion, subject to applicable law.
• We may contact you to confirm details, suggest substitutions, or clarify compliance issues.

We can cancel all or part of an order, or require changes, for reasons that include:

• Product is out of stock.
• You are outside our delivery zone.
• Age or identity cannot be verified.
• We believe the order violates law, our license conditions, or these Terms.
• Suspected fraud, abusive behavior, or obvious pricing errors.

If we cancel or modify an order after you have paid, we will refund the relevant amount or issue a store credit, as allowed by law and our policies.

7. Pricing, taxes, and fees

Prices, taxes, and fees shown on the Services are subject to change at any time.

At checkout, you may see:

• Product prices.
• Sales taxes and any other required taxes or cannabis-related fees.
• Delivery fees and service charges, if applicable.

The final amount at checkout is an estimate until we confirm and finalize the order. If a clear pricing mistake happens (for example, a product listed at $0.01 instead of $10), we may correct it and contact you.

8. Payments

We use third-party payment processors and tools to handle online payments and may also offer cash or similar payment methods at delivery.

By providing payment information, you confirm that:

• You are authorized to use that payment method.
• You authorize us and our payment partners to charge the full order total, including taxes and fees.

We do not store full payment card numbers on our own servers. Our payment partners handle card data and are responsible for their own security and compliance.

If a payment fails or is reversed, you remain responsible for any amounts owed, as allowed by law.

9. Delivery and risk of loss

Delivery is only available:

• Within our approved delivery area in California.
• To locations where cannabis delivery is legal.

At delivery:

• The person receiving the order must be present, at least 21 (or 18 with valid medical documentation where allowed), and must show a valid government-issued ID.
• We may refuse to complete the delivery if we cannot verify age or identity, if no eligible adult is present, or if we suspect reselling or unlawful use.

Ownership and risk of loss transfer to you when we deliver the order and an eligible person accepts it at the address you provided.

We do not ship cannabis by mail, across state lines, or outside California.

10. Returns, replacements, and order problems

Because of cannabis regulations, returns are very limited.

In general:

• We do not accept returns of opened or used cannabis products.
• We may, at our discretion and where allowed by law, offer a refund, credit, or replacement if there is a serious issue such as wrong item, damaged product, or non-delivery caused by us.

If there is a problem with your order, contact us as soon as possible through the Contact page on ondeckdelivery.com and include your name, order number, and a clear description of the issue.

Our posted refund or replacement policy, if any, is part of these Terms.

11. Promotions, discounts, and loyalty programs

We may offer promotional deals, discount codes, referral programs, and loyalty rewards.

• Each promotion has its own rules, including eligibility, time limits, minimum purchase amounts, which products qualify, and whether it can be combined with other offers.
• We can change or cancel promotions at any time, as long as we follow applicable law.
• Promotions usually cannot be exchanged for cash.

We use tools such as Alpine IQ Marketing, Alpine ecommerce / AIQ Ecommerce, and related systems to run promotions, loyalty points, personalized offers, and campaign analytics.

If there is a conflict between a general description on a banner and the fine print of a specific promotion, the fine print controls.

12. Text messages, emails, and TCPA consent

We use SMS and email to send:

• Order-related messages (for example, order status and delivery updates).
• Marketing messages about deals, new products, loyalty rewards, and events, if you opt in.

By providing your phone number and agreeing to receive texts, you agree that:

• You may receive marketing and/or transactional text messages from On Deck Delivery at the number you provide.
• Message frequency may vary.
• Message and data rates may apply.
• You can opt out of marketing texts at any time by replying STOP. For help, you can reply HELP or contact us through the website.
• Your consent to receive marketing texts is not required to make a purchase.

For email marketing, you can opt out by clicking the unsubscribe link in any marketing email. You will still receive important non-marketing messages such as order confirmations and notices about changes to these Terms or the Privacy Policy.

We keep records of your opt-in and opt-out choices to show we are following SMS and email rules.

13. Acceptable use rules

You agree that you will not:

• Use the Services for any illegal purpose or in violation of any law or regulation.
• Purchase cannabis on behalf of someone who is not legally allowed to buy or receive it.
• Attempt to resell or divert products in a way that violates California law.
• Interfere with or disrupt the Services or any servers or networks connected to them.
• Use robots, scrapers, or other automated tools to access the Services without our consent.
• Try to bypass security features, age gates, or geographic limits.

We can suspend or terminate access to the Services, cancel orders, or take other steps when we believe this section has been violated.

14. Health warning and safe use

Cannabis products can be intoxicating and may impair judgment, motor skills, and decision-making. Effects may be delayed and stronger than expected, especially with edibles.

You should not:

• Drive or operate machinery while using cannabis.
• Use cannabis if you are pregnant or nursing without first talking to a doctor.

California requires strong warnings about delayed effects and risks for pregnant or breastfeeding people on cannabis labels and marketing. Our site and packaging will include legally required warnings where needed.

Use our products responsibly and keep them away from children, pets, and anyone who is not legally allowed to use them.

15. Intellectual property

All content on the Services, including logos, branding, product photos we create, graphics, text, and the overall look and feel, is owned by us or our licensors and is protected by copyright, trademark, and other laws.

You may not copy, modify, adapt, translate, distribute, or create derivative works based on any part of the Services without our written permission, except as allowed by law for your own personal use.

You may not use our name, logos, or branding in a way that suggests you are affiliated with us or that we endorse you without our written consent.

16. Third-party services and technology

The Services use and integrate with third-party tools, including:

• Alpine IQ Marketing and related services for loyalty programs, segmenting customers, sending SMS and email marketing, and analytics.
• Alpine ecommerce / AIQ Ecommerce and related ecommerce technology for online menus, carts, and checkout.
• Google Analytics and similar tools to understand traffic, usage, and performance.
• Payment processors, hosting providers, and communication platforms.

These third parties have their own terms and privacy policies. We do not control them and are not responsible for their content, policies, or actions. Your use of third-party services is at your own risk.

17. Disclaimer of warranties

The Services are provided “as is” and “as available.”

To the fullest extent allowed by law, we do not make promises or warranties about:

• The Services always being available, secure, or error-free.
• The accuracy, completeness, or reliability of any content or information.
• The performance or effects of any product, beyond what is required by law.

You use the Services and products at your own risk.

18. Limitation of liability

To the fullest extent allowed by law:

• Our total liability to you for any claim arising out of or relating to the Services, products, or these Terms will not be more than the greater of (a) the amount you paid to us for the order involved in the claim, or (b) one hundred dollars (US $100).
• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption.

Some laws do not allow certain limits, so some of the above may not apply to you.

19. Indemnification

You agree to indemnify and hold harmless On Deck Delivery and our owners, employees, and partners from and against any claims, damages, losses, liabilities, and expenses (including legal fees) that arise from:

• Your use or misuse of the Services or products.
• Your violation of these Terms.
• Your violation of any law or any third-party rights.

20. Changes to the Services and these Terms

We can change, suspend, or stop any part of the Services at any time.

We can update these Terms at any time. When we do, we will update the date at the top of this page and may post a notice on the website if the changes are significant.

If you keep using the Services after we post updated Terms, you agree to the new version.

21. Governing law and disputes

These Terms and any disputes related to them or to the Services are governed by the laws of the State of California, without regard to conflict-of-law principles.

Any legal action or proceeding must be brought in the state or federal courts located in Orange County, California. You consent to the personal jurisdiction of those courts.
